iMediaNZ Booking Terms

These are the terms for every booking with iMediaNZ Creative Studio (Dennis Toetoe, sole trader, Cambridge, Waikato). They're written in plain English on purpose. Paying your deposit means you've read and accepted them.

1. Booking and payment

  • A 50% deposit secures your date. Your booking isn't confirmed until the deposit is paid.
  • The balance is invoiced on the day your content is delivered, payable within 7 days.
  • Public website prices are shown before GST. Your quote and invoice show the GST component and the full amount payable.
  • Travel within 50km of Cambridge is included. Beyond that, travel is $1 + GST per round-trip kilometre over the free zone and is shown on your quote before you book.
  • Invoices come through Hnry on behalf of Dennis Toetoe.

2. What you get

  • The deliverables, turnaround time and price are set out in your quote, based on the package you've chosen.
  • Every package includes one round of revisions. Further revision rounds are charged at the current add-on rates.
  • Turnaround starts from the shoot date. If we're waiting on something from you, the clock pauses until we have it.

3. Cancellation and rescheduling

  • You cancel 14 days or more before the shoot: your deposit is refunded, less the cost of any work already done, including planning, travel bookings or pre-production.
  • You cancel less than 14 days before the shoot: the deposit is non-refundable. It covers the date held for you and work turned away.
  • Weather: outdoor shoots get one free reschedule if the weather makes the planned work impractical or unsafe. We'll choose the new date together.
  • We cancel: if iMediaNZ has to cancel and we can't offer a reshoot date that works for you, everything you've paid comes back to you in full.

4. Copyright and how you can use the work

  • iMediaNZ keeps the copyright in everything we create for you. This is our agreement to the contrary under section 21(3) of the Copyright Act 1994.
  • You receive a broad licence to use, share, post, print and publish the delivered files for your own personal or business purposes for as long as you like, at no extra cost.
  • The licence does not cover reselling the files or passing them to a third party for their own commercial use without checking with us first.
  • iMediaNZ may use the work in our portfolio, showreel, website and social media. If you'd rather we didn't, tell us before the shoot.
  • For funeral and memorial work, nothing is used publicly without clear written permission from the family.

5. If something goes wrong

  • If equipment failure, file corruption or illness stops us delivering, our first move is to put it right through a reshoot, a replacement shooter, or a partial delivery with a fair price reduction.
  • If it genuinely can't be put right, we refund what you've paid for the affected work.
  • Our total liability for any booking is capped at the total fees you've paid for that booking. We're not liable for indirect losses such as lost profits or lost opportunities connected to the content or its delivery.

6. Your side of the deal

  • Provide the access, permissions and information the shoot needs, including venue access, schedules and key people to capture.
  • If the shoot involves people, you're confirming you have the right to have them filmed or photographed for the agreed purpose.

7. Safe working

iMediaNZ works to keep everyone safe on a shoot. We can pause or stop filming if conditions become unsafe, and we'll talk to you before that affects the deliverables.

8. Consumer Guarantees Act 1993

  • If you're booking as a consumer, nothing in these terms limits your rights under the Consumer Guarantees Act.
  • If you're a business acquiring these services in trade, you and iMediaNZ agree that the Consumer Guarantees Act 1993 does not apply to this booking, that this is fair and reasonable, and that both parties are in trade under section 43.

9. The necessary details

  • These terms are governed by New Zealand law.
  • If one clause turns out to be unenforceable, the rest still stand.
  • These terms plus your quote are the whole agreement. Changes only count if both sides agree them in writing, including by email.

Tribute & Memorial Film schedule

These points apply to Tribute & Memorial Film bookings. Where they differ from the general cancellation terms, this schedule wins.

  • One free change: the family can change the booked date or timing once without a fee, subject to availability.
  • Cancellation before travel: payments are refunded less the fair cost of work already completed and any non-refundable third-party costs.
  • Once travel or filming begins: the deposit is retained. Any amount paid above the deposit is refunded unless it relates to work already completed or non-refundable costs.
  • Privacy: delivery is private. iMediaNZ never posts, shares or uses funeral or memorial footage publicly without clear written permission from the family.
  • Consent: the booking contact confirms the family, venue and relevant service leaders have approved filming.
